Terms of Service

These Terms of Service ("Terms") govern your use of the Blackjack Sense mobile application ("the App") provided by Zigzag Studios LLC ("we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. The App simulates casino card play for educational and entertainment purposes only. It is not intended for use by anyone under 18.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, in accordance with Apple's Media Services Terms and Conditions.

3. Subscriptions

The App offers optional auto-renewing subscriptions that unlock additional lessons, drills, and features:

• Pro Monthly — $4.99 per month
• Pro Yearly — $29.99 per year

Auto-renewal. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID is charged at confirmation of purchase and again at each renewal at the then-current price.

Managing your subscription. You can view and cancel subscriptions in your device's App Store settings (Settings → Apple ID → Subscriptions). Cancelling stops future renewals but does not refund the current billing period.

Restore Purchases. Prior subscription purchases can be restored via the "Restore" link on the subscription screen inside the App.

Refunds. All payments are handled by Apple. Refund requests are subject to Apple's policies and can be made at reportaproblem.apple.com.

4. Not Real-Money Gambling

The App is a strategy trainer. It does not involve real-money gambling, betting, or wagering. All in-app currency ("chips") is simulated, has no monetary value, and cannot be exchanged for real money, prizes, or other consideration. Simulated outcomes in the App are not indicative of results in actual gambling and should not be relied on as such.

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or otherwise attempt to derive source code from the App
• Use bots, scripts, or automated tools to interact with the App
• Attempt to bypass or exploit anti-cheat, integrity, or attestation mechanisms (including Firebase App Check and Apple's App Attest)
• Interfere with, disrupt, or compromise the security of the App or its backend
• Attempt to gain unauthorized access to another user's account or data
• Use the App to violate any applicable law or the rights of others

Violations may result in immediate account suspension or termination.

6. User Accounts

An anonymous account is created automatically when you first launch the App. You may optionally link the account to your Apple ID via Sign in with Apple. You are responsible for all activity that occurs on your account. You can delete your account at any time via Settings → Delete Account within the App.

7. Intellectual Property

Blackjack Sense — including its name, logo, artwork, source code, lesson and drill content, animations, sounds, and all associated materials — is owned by Zigzag Studios LLC and protected by copyright, trademark, and other intellectual property laws. Your license under Section 2 does not transfer any ownership. All rights not expressly granted are reserved.

8. Third-Party Services

The App depends on services provided by Apple (Sign in with Apple, StoreKit, App Store) and Google Firebase (Authentication, Firestore, Analytics, Crashlytics, App Check). These services may become temporarily unavailable due to maintenance or outages outside our control. We are not responsible for downtime, data loss, or other issues caused by these services. Your use of these services is also subject to their respective terms.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free from viruses.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall Zigzag Studios LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the App, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising from or related to the App will not exceed the greater of (a) the amounts you paid us in the twelve months preceding the claim or (b) fifty US dollars ($50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any violation of these Terms. Sections 4, 7, 9, 10, 11, and 13 survive termination.

12. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be surfaced in the App or via email when appropriate. Your continued use of the App after an update constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. Any dispute arising under or relating to these Terms will be resolved exclusively in the state or federal courts located in Oregon, and you consent to the personal jurisdiction of those courts.
